Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ETF·AI platform, websites, and applications (the “Service”), operated by FINTECHME LLC (“we”, “us”, “our”). By accessing or using the Service you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract. You may not use the Service where prohibited by applicable law, or if you are located in, or a resident of, a jurisdiction subject to comprehensive sanctions. You are responsible for compliance with the laws of your jurisdiction.

2. The Service

ETF·AI provides access to on-chain crypto index products (“Indices”). Each Index is a basket of digital assets with defined target weights, held in a segregated treasury and rebalanced by an automated engine. When you deposit, a smart contract issues index shares representing your proportional interest; when you redeem, shares are burned and you receive value based on the current net asset value (“NAV”).

The Service may be accessed with a self-custodial wallet (you control your keys) or via a linked custody account. NAV figures, performance data, and illustrations shown in the Service are provided for information only and may be estimated, delayed, or inaccurate.

3. Accounts & Security

You are responsible for safeguarding your account credentials, wallet keys, and any two-factor secrets. We are not liable for loss resulting from unauthorised use of your account or wallet. Notify us immediately of any suspected compromise.

4. Wallets, Custody & Transactions

• Blockchain transactions are irreversible. You are responsible for the addresses, amounts, and networks you transact with.
• We do not control third-party networks (e.g. Polygon), oracles, or decentralised exchanges, and are not responsible for their availability, fees, or failures.
• Where you use a custody account, custody services are provided under the terms of the custody provider, and additional verification may be required.

5. Fees

Standard fees are 0.5% on entry and 0.5% on exit (a 1% round trip), deducted at the time of the transaction. Network (gas) costs and third-party swap fees are additional. Fees may change; the applicable fee is the one displayed at the time of your transaction.

6. No Investment Advice

Nothing in the Service constitutes investment, financial, legal, or tax advice, or a recommendation to buy, sell, or hold any asset. Indices are not registered securities or collective investment schemes unless expressly stated. You make your own decisions and bear your own risk.

7. Prohibited Use

You agree not to: use the Service for money laundering, terrorist financing, fraud, or sanctions evasion; interfere with or attack the Service; misrepresent your identity; or use the Service in violation of applicable law.

8. Intellectual Property

The Service, including its design, text, and software, is owned by FINTECHME LLC and protected by intellectual-property laws. Smart contracts may be published under separate open-source licences where indicated.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that NAV or price data will be accurate.

10. Limitation of Liability

To the maximum extent permitted by law, FINTECHME LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, digital assets, or data, arising from your use of the Service. Our aggregate liability will not exceed the fees you paid to us in the three months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless FINTECHME LLC from any claims arising out of your use of the Service or your breach of these Terms.

12. Termination

We may suspend or terminate your access at any time, including for suspected breach of these Terms or applicable law. Provisions that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which FINTECHME LLC is established, without regard to conflict-of-laws rules. The competent courts of that jurisdiction have exclusive jurisdiction, subject to any mandatory consumer-protection rights you may have.

14. Changes

We may update these Terms from time to time. Material changes will be notified via the Service. Continued use after changes take effect constitutes acceptance.
